Terms of service

1. The parties

These terms are between StriveBit Technologies Private Limited (CIN U72900UP2021PTC142374, [Registered address]), which we call Thaalo, and the restaurant or food business that subscribes, which we call you. By starting a trial or paying for a plan you agree to these terms.

2. The service

Thaalo provides a digital menu, QR and online ordering pages for your customers, an order board and kitchen screen, billing, and reports, as described on thaalo.in. Features vary by plan. We may improve or change features; we will not remove a feature your plan includes without 30 days’ notice.

3. Accounts and access

• You are responsible for the staff accounts you create and for keeping passwords private.
• You must give us accurate business details and keep them current.
• You must have the right to sell the items on your menu and to use the names, photos and logos you upload.

4. Pricing and payment

• Plans are priced per month, exclusive of GST: Counter ₹999; Table ₹1,499; Chain ₹1,199 per outlet, minimum 3 outlets.
• Annual payment covers twelve months for the price of ten.
• Every plan starts with a free trial of 7 days. You are not charged unless you continue after the trial.
• Founding 30 restaurants pay ₹999 per month for the Table plan, locked for 12 months from activation. After that the list price applies unless we agree otherwise in writing.
• Monthly plans are billed in advance. Payment is by UPI or bank transfer until online payment is available.
• Until we are registered under GST, invoices are issued without GST. Once registered, GST is added at the applicable rate.
• If a payment is 15 days late we may pause the service after a reminder on WhatsApp. Your data is kept for 30 days after a pause.

5. Referral credit

A Founding 30 restaurant that refers another restaurant receives one free month once the referred restaurant has completed 30 paid days. Credits are applied to the next invoice and are not paid out in cash.

6. Cancellation

• You can cancel at any time by WhatsApp or email. There is no notice period and no cancellation fee.
• The current month is not refunded. Annual plans are refunded as described in the refund policy.
• We may end the service for breach of these terms, unlawful use, or non-payment, with notice where practical.

7. Your data

• Your menu, orders, customers and reports belong to you. We use them only to run the service and as described in the privacy policy.
• On request we export your menu and order history in CSV format, during the subscription and for 30 days after it ends.
• Thirty days after closure we delete your data, except records we must keep by law.

8. Acceptable use

You may not use Thaalo to sell anything unlawful, to send unsolicited messages, to attempt to access another restaurant’s data, or to interfere with the service. We may suspend an account that does.

9. Availability and support

We aim to keep the service available at all times and to answer WhatsApp support within 15 minutes between 10 am and 11 pm IST, and within an hour otherwise. We do not guarantee uninterrupted availability. Planned maintenance is announced at least 24 hours ahead and scheduled outside meal hours. The service depends on your internet connection and devices, which are your responsibility.

10. Liability

Thaalo is provided as described, and we are not liable for indirect losses such as lost profits or lost orders. Our total liability to you in any twelve-month period is limited to the fees you paid us in the three months before the claim. Nothing in these terms limits liability that cannot be limited under Indian law.

11. Changes to these terms

We may update these terms. Material changes are notified on WhatsApp or email 30 days before they apply. Continuing to use the service after that date means you accept them.

12. Law and disputes

These terms are governed by the laws of India. Disputes are subject to the courts at Chandigarh. Before going to court, both sides agree to try to resolve the matter by talking, starting with an email to [email protected].
